While that principle is to be gratefully praised it is insufficient, in itself, to guarantee the protection it is meant to provide. White, black or Hispanic, of whatever income category, the system, including judges, prosecutors and juries often, reflexively, make assumptions without evidence, don’t see the accused as fully human and deserving of respect, much less possessed of the right to be given the benefit of the doubt. Of course, many do.
As a defense lawyer, I’m determined to shift that narrative. Amy, my assistant for 23 years, and I see the beauty in each individual despite the charges brought against them. We see their strength, we recognize our common humanity, and We return their phone calls. We have genuine empathy. We sit with them. We do our best to answer their questions and we listen to them intently. Why am I being charged? Why was my property seized? What’s happening with my case.
We emphasize it is “our case” because we are not part time, halfhearted advocates but a defense team 100% committed to protecting their rights. We act out of duty but more than duty, we are professionals pursuing a calling to be of service and “ champions of Liberty.”
